To whom does the الولاء pass if the manumitter leaves no paternal relatives ('Asaba) or heirs?
Chapter on Inheritance of Wala'
Al-Mughni
Book of Walā' (Patronage)
Primary text
If the manumitter leaves no paternal relatives or heirs, the الولاء passes to the master of the manumitter (Mawla Mawlahu), then to his closest paternal relatives. If the manumitter's lineage, the masters of the manumitters, and their descendants all perish, the estate belongs to the public treasury (Bayt al-Mal). This ruling applies only when the manumitter leaves no direct heirs or paternal relatives, as they would rightfully claim inheritance and liability (Aql) over the master's paternal relatives and children.
Supporting text
If the deceased manumitter leaves only the son of his manumitter and the paternal relatives of his manumitter, the inheritance goes to the son of the manumitter because he is the closest paternal relative of the manumitter.
