To whom does the right of 'Al-Wala' (patronage/allegiance following manumission) belong?
General Chapter
Al-Mughni
Book of Walā' (Patronage)
Primary text
The right of *Al-Wala* belongs exclusively to the person who frees a slave. The consensus of the scholars affirms that whoever manumits a slave, or a slave is manumitted on their behalf, and the manumission was not done without consideration (*sa'ibah*), holds the right of *Al-Wala*. This is established by the statement of the Prophet, peace be upon him: "Al-Wala belongs to the one who frees." Furthermore, this right is described as being like the tie of kinship (*lahmat al-nasab*), implying inheritance rights.
Supporting text
The Prophet, peace be upon him, prohibited the sale and the gift of *Al-Wala*.
