To whom does the *Wala'a* (right of patronage/inheritance) belong when a person bequeaths manumission after their death?
General Chapter
Al-Mughni
Book of Walā' (Patronage)
Primary text
If a person bequeaths that a slave be freed after their death, and the slave is freed, the *Wala'a* belongs to the testator (the one who made the bequest). This ruling applies equally if the testator bequeathed the manumission of their slave without specifying that it should be done 'on my behalf.' The manumission is considered an expenditure from their wealth, thus the *Wala'a* accrues to them.
