Does a woman inherit the *Walaa* of the person her father manumitted?
Chapter on Inheritance of Wala'
Al-Mughni
Book of Walā' (Patronage)
Primary text
A woman does not inherit the *Walaa* of the person her father manumitted; this is treated like the inheritance relationship where she would inherit from her father's uncle (her great-uncle), an inheritance that accrues to the male heirs (*'asaba*), not to her. Thus, her brother inherits it, similar to kinship rules. In a case where a man left behind the son of his freed slave and the daughter of his freed slave, the inheritance goes exclusively to the son of the freed slave.
Supporting text
According to an alternative narration, the inheritance is divided between the son and daughter of the freed slave in thirds. If the man left only the daughter of his freed slave, she receives nothing, and the wealth goes to the public treasury (*Bayt al-Mal*), unless under the alternative narration, in which case the inheritance belongs to her.
