Is judicial dissolution (Faskh) of marriage permissible for prolonged absence without a valid excuse?

In all cases concerning the dissolution of marriage due to prolonged absence, dissolution is not permissible except by the ruling of a judge (Hakim), because the issue is subject to scholarly disagreement.
