Is a wife permitted to leave her husband's house without his permission for necessary visits?
General Chapter
Al-Mughni
Book of the Wedding Feast
Primary text
The husband has the right to prevent his wife from leaving his house for any reason, even for visiting her parents, attending to them if they are ill, or attending their funeral. Ahmad stated that obeying the husband is more obligatory upon the wife than obeying her mother unless the husband grants permission. This is supported by a narration where the Prophet, peace be upon him, advised a woman whose father was ill and dying not to disobey her husband, and Revelation indicated her forgiveness was due to her obedience to her husband. The basis for this ruling is that obedience to the husband is obligatory, while visiting the ill or attending a funeral is not obligatory, and a mandatory act cannot be abandoned for a non-mandatory one.
Supporting text
Although the husband has the right to prevent her exit, it is not appropriate for him to do so regarding visiting or seeing her parents, as this leads to severing familial ties and may push the wife to disobey him. Furthermore, God commanded kind association, and preventing such visits does not constitute kind association.
