Is an apostate put to death if they kill a Muslim or a protected non-Muslim (Dhimmi)?
General Chapter
Al-Mughni
Book of Wounds
Primary text
The apostate is killed if they murder a Muslim or a Dhimmi. Retaliation (*Qisas*) for murder takes precedence over the punishment for apostasy because the right pertains to a human being. If the heir of the murdered person pardons the murderer, the apostate owes the blood money (*diyah*) of the slain person. If the apostate embraces Islam, this debt remains binding upon them. If the apostate is executed for apostasy or dies, the right to blood money attaches to their estate.
