What happens if the offered left hand results in the victim's death?
Chapter on Retaliation (Qawad)
Al-Mughni
Book of Wounds
Primary text
If the injury from cutting the left hand proves fatal, the cut is considered worthless (Hadar), and the Diyya for the right hand must be paid from the perpetrator's estate because the stipulated retribution cannot be executed due to the death.
Supporting text
If the injury results in death, the full Diyya is owed, and since the cutting of the right hand is now impossible, half the Diyya is offset against the entitlement for the right hand, leaving the remaining half for the perpetrator's heirs.
