If the method used to kill (other than the sword) is matched but the victim does not die, what is the ruling?
Chapter on Retaliation (Qawad)
Al-Mughni
Book of Wounds
Primary text
According to the narration permitting matching the act, if the matching act is performed and the victim does not die, the execution proceeds by the sword. This is one opinion of Al-Shafi'i.
Supporting text
The second opinion holds that the act must be repeated upon the perpetrator until death occurs by it, because the initial act caused the death, thus the execution should match it exactly.
