Is reattachment of a severed piece of flesh obligatory to remove?
Chapter on Retaliation (Qawad)
Al-Mughni
Book of Wounds
Primary text
If a detached piece of human flesh is reattached, its removal is obligatory if the detached part is considered impure (najis). Removal is waived only if removal poses a risk of harm, similar to setting a broken bone with impure bone. If the detached part is considered pure, its removal is not obligatory. This latter view is the preferred position, held by Abu Bakr, 'Ata ibn Abi Rabah, and 'Ata al-Khurassani, because the human part remains pure in death as it was in life, thus retaining its purity as when it was attached.
Supporting text
If a part of the ear is cut and reattached, removal is not obligatory because it is pure under both legal opinions as it has not become dead due to remaining attached. There is no retribution (qisas) for it.
