Is retaliation (Qisas) due if a finger is severed and subsequently suffers necrosis (aklah) leading to amputation by the injured party?
Chapter on Retaliation (Qawad)
Al-Mughni
Book of Wounds
Primary text
If a finger is severed and the resulting wound develops necrosis, causing the hand portion to fall off from a joint, retaliation (Qisas) is due for the injury. If the injured party preemptively amputates the finger at the wrist (koo') to prevent the necrosis from spreading to the rest of the body, the perpetrator owes Qisas for the finger, and *Hukuma* (discretionary compensation) for the part of the palm that decayed. No liability falls upon the perpetrator for the part the injured party amputated because that loss was due to the injured party's own action.
