Is retaliation (Qisas) required for injuries to the protruding flesh between the thighs and the back beside the anus (Al-Alyatayn)?
Chapter on Retaliation (Qawad)
Al-Mughni
Book of Wounds
Primary text
Retaliation (Qisas) is obligatory for injuries inflicted upon the two protruding buttocks (Al-Alyatayn) located between the thighs and the back beside the anus. This is the apparent position within the Shafi'i school. The evidence for this ruling is the statement of Allah Almighty: {And We ordained for them therein: a life for a life} (Quran 5:45), referring to injuries in general. Furthermore, because these areas have a definable termination point, retaliation applies, similar to the penis and testicles. This view is held by Masruq, Al-Hasan, Ibn Sirin, Al-Sha'bi, Al-Nakha'i, Al-Zuhri, Al-Thawri, Malik, Al-Shafi'i, Ishaq, Abu Thawr, and the companions of the view (Ashaab ar-Ra'y). A narration supports this from Ali, may Allah be pleased with him.
Supporting text
Al-Muzani holds that there is no retaliation for injuries to these areas because they constitute flesh connected to other flesh, making them analogous to the flesh of the thigh.
