What is the ruling when a person intentionally removes the eye of someone who has only one eye (like their own)?

Retaliation (Qisas) is mandatory without dispute when a person intentionally removes the only eye of another person who has a similar eye (in terms of being a right or left eye). This is due to their absolute equality in all aspects. If the injured party pardons the perpetrator in exchange for blood money (Diyya), the perpetrator owes the full Diyya. This ruling applies equally if the removal occurred by mistake (error) or if some of those entitled to Qisas forgive the perpetrator, because the entire sight of the victim has been destroyed, equating the case to removing the eye of a person who previously had two sound eyes.
