Primary text

There is a difference of opinion among the followers of Al-Shafi'i concerning retaliation for the loss of sight in all the aforementioned situations. Some scholars state that there is no retaliation for the loss of sight because it is not obligatory due to transmission (*sarayah*), similar to when severing a finger transmits damage to the adjacent one, which they consider irredeemable by direct retaliation. Conversely, other scholars hold that retaliation is obligatory in such cases unanimously, arguing that direct injury to the sight of the eye is impossible, thus it is compensated by transmission, akin to homicide, meaning retaliation applies to the sight as previously discussed.
