The ruling on rushing retaliation before the wound heals.

Chapter on Retaliation (Qawad)

Al-Mughni

Book of Wounds

Book 47 · Issue 2 · Bab 2

Open in Qurani

Primary text

Rushing the execution of retaliation (Qisas) before the injured person has healed is prohibited. This is established by the narration of Jabir, where the Prophet, peace be upon him, explicitly forbade enacting Qisas for wounds until the injured person heals. Furthermore, executing Qisas when the nature of the wound—whether it will result in death or not—is unknown necessitates waiting for clarity regarding its final outcome.

Supporting text

The action of the man who rushed the Prophet, peace be upon him, to execute retaliation before healing was deemed a disobedience, as evidenced by the Prophet's statement, 'I forbade you, and you disobeyed me.' The version of the narration detailing this exchange, which was transmitted by Al-Daraqutni, includes a statement where the Prophet declares the retaliation void due to the haste. This addition is accepted as it occurred subsequent to the initial command and effectively abrogates the initial permission to retaliate.
