Is a supernumerary finger on the injured party to be disregarded when applying Qisas (retaliation) for amputation?
Chapter on Retaliation (Qawad)
Al-Mughni
Book of Wounds
Primary text
According to the view of Ibn Hamid, the supernumerary finger is not considered; it is treated as a benign growth or surplus item. Therefore, if the hands of both the cutter and the injured party are complete, and the injured party possesses an extra finger, the extra finger is ignored for retaliation purposes.
Supporting text
Another view holds that the hand of the perpetrator may be amputated against the hand of the injured party, even with the presence of the extra finger.
