Is there a ruling on Qisas for the severed limb if the amputation occurred during a period when the injury would not typically lead to death (sarayah)?
General Chapter
Al-Mughni
Book of Wounds
Primary text
If the state of apostasy during the initial injury was such that the injury would not ordinarily lead to death (non-sarayah), then either blood money (Diyyah) or retaliation (Qisas) is due for the subsequent murder.
Supporting text
Al-Shafi'i, in one of his two established opinions, holds that no Qisas is due because the victim ultimately reached a state where, had he died from the initial injury, Qisas would not have been required.
