The estimation (kharas) of olives, and other fruits besides date palms and grapes, is not permissible. This is because the fruit of the olive tree is scattered on the tree and concealed by its leaves, and the owners do not have an immediate need to consume it while it is still on the tree. This ruling is held by Malik. The basis for this ruling is the absence of explicit textual evidence (nass) supporting its estimation (kharas), nor does it share the essential nature of those matters where estimation is explicitly legislated, thus the original state (that it remains unestimated) is upheld.

Al-Zuhri, Al-Awza'i, and Al-Layth hold that the estimation of olives is permissible because it is a fruit upon which Zakat is obligatory, making it analogous to fresh dates (rutab) and grapes, which are estimated.
