Primary text

The obligation for Zakat on excavated minerals becomes due immediately upon extraction when the possessor acquires them and they reach their minimum threshold (Nisab); a full Hawl (lunar year) is not required for its obligation. This is the position held by Malik, Al-Shafi'i, and the Ashab al-Ra'y (Hanafi scholars). The evidence for this is that it is newly acquired wealth derived from the earth, and thus, like crops, fruits, and Rikaz (buried treasure), a Hawl is not required for its Zakat obligation. Furthermore, the Hawl is typically established for wealth that develops incrementally, whereas the growth of minerals is completed in one instance, similar to harvested crops. Therefore, the Prophetic narration regarding the requirement of a Hawl is specific to crops and fruits, and this case should be resolved by analogy (Qiyas) with them.

Supporting text

Ishaq and Ibn al-Mundhir hold that nothing is due on minerals until a full Hawl passes over them, based on the saying of the Messenger of Allah (peace be upon him): "There is no Zakat on wealth until a Hawl passes over it."
