Primary text

If the estimation results in a substantial surplus, such as double the actual yield, the individual must give away the excess (*faḍl*), because the estimation is conducted uniformly. This ruling suggests the opinion held by Malik. If the ruling authority waives a portion of the mandatory one-tenth, the individual must still pay what was estimated and remit that amount.

Supporting text

If the ruling authority reduces the estimated *kharas* from the land, the individual must give charity equal to the amount by which the estimation was reduced.
