What is the ruling when one owner buys forty sheep that were mixed with other property, adds forty separate sheep to them, and immediately mixes the resulting total?
Chapter on Zakat on Sheep
Al-Mughni
Book of Zakat
Primary text
If each owner had forty sheep mixed with other property, and then they traded them while maintaining the mixture and sending them out mixed, the rule of mixture is not invalidated.
Supporting text
If one owner buys forty sheep mixed with other property using forty separate sheep and mixes them immediately, it is plausible that they pay the Zakah of mixture because the Hawl builds upon the mixed period, and the period of separation is considered slight and overlooked. Alternatively, it is plausible they pay the Zakah of an individual owner due to the occurrence of separation for part of the Hawl.
