What is the ruling regarding Zakat on usurped gold that the usurper crafts into jewelry?
Chapter on Zakat on Debt and Charity
Al-Mughni
Book of Zakat
Primary text
If gold is usurped and then crafted into jewelry, this situation is distinct from the dispute over feeding. Crafting jewelry does not negate a condition for Zakat obligation, but feeding negates the condition for its obligation. If the crafting was permissible, the question concerns whether it waives Zakat; if it is prohibited, the condition for waiver is unmet. If the owner had fed the animal with prohibited means, Zakat would be dropped, but if the owner had crafted it with prohibited crafting, Zakat is not dropped, showing a difference.
Supporting text
If permissible jewelry is usurped and then broken down or struck into coins or dinars, Zakat becomes obligatory because the factor that waived Zakat has been removed. However, it is plausible that Zakat is not due, similar to when a fed animal is usurped and then declared grazing.
