What is the ruling on Zakah for crops or fruit from a jointly owned endowment (*Waqf*)?
Chapter on Zakat on Sheep
Al-Mughni
Book of Zakat
Primary text
If a group possesses a jointly owned endowment or orchard containing fruit or crops, there is no Zakah incumbent upon them unless the portion belonging to one individual reaches a complete *Nisab*. This is explicitly mentioned by al-Kharqi.

According to the alternative narration regarding combination in non-livestock assets, if the entire yield constitutes a *Nisab*, Zakah is due. If the *Waqf* constitutes a *Nisab* of livestock, Zakah may be due due to the joint ownership of a *Nisab* where combination is effective, and the Zakah should be paid from other wealth since transferring ownership from the endowment is impermissible. Conversely, Zakah might not be due due to the inherent deficiency in ownership rights within a *Waqf*, analogous to the ruling concerning the wealth of a contractually freed slave (*mukatab*).
