Is Zakat obligatory on spontaneously growing, unowned vegetation (like wild barley or plants picked from unowned land)?
Chapter on Zakat on Crops and Fruits
Al-Mughni
Book of Zakat
Primary text
Zakat is not obligatory on vegetation that grows on unowned, permissible land that only becomes owned through taking possession of it, such as atam, 'afas, za'bal (mountain barley), 'afas seeds, purslane seeds, thumam seeds, and qat (mustard seeds) when they reach maturity and bitterness/saltiness develops. This is because ownership is established only upon taking possession. Zakat obligation arises only when the produce is owned; since the owner did not own it at the time the signs of ripeness appear, the obligation does not attach, similar to found property (luqatah) collected from grain stalks, for which there is no Zakat. Ahmad explicitly stated this ruling.
