Hadith 38:24

Yahya ibn Adam narrated to us, he said: Mas'ud ibn Sa'd al-Ju'fi narrated to us, from 'Ata' ibn al-Sa'ib, from Abu al-Bakhtari, who said: When the people of the Camel were defeated, 'Ali said: "No slave who has left the camp is to be sought, and whatever there is of beasts or weapons, it is for you. But you have no right to the slave-mothers (umm al-walad), and inheritances are according to the obligatory shares of Allah. And any woman whose husband was killed, let her observe an 'iddah (waiting period) of four months and ten days." They said: "O Commander of the Faithful, their blood is lawful for us, yet their women are not lawful for us?" He said—and they disputed with him—he said: "Such is the conduct (sirah) regarding the People of the Qiblah." He said: "Then bring your shares and cast lots for 'A'ishah, for she is the head of the matter and their leader." He said: So they dispersed and said: "We seek Allah's forgiveness." He said: So 'Ali defeated them in argument.

حدثنا يحيى بن آدم قال حدثنا مسعود بن سعد الجعفي عن عطاء بن السائب عن أبي البختري قال لما انهزم أهل الجمل قال علي لا يطلبن عبد خارجا من العسكر وما كان من دابة أو سلاح فهو لكم وليس لكم أم ولد والمواريث على فرائض الله وأي امرأة قتل زوجها فلتعتد أربعة أشهر وعشرا قالوا يا أمير المؤمنين تحل لنا دماؤهم ولا تحل لنا نساؤهم قال فخاصموه ( ( ( فخاصموا ) ) ) فقال كذلك السيرة في أهل القبلة قال فهاتوا سهامكم واقرعوا على عائشة فهي رأس الأمر وقائدهم قال ففرقوا وقالوا نستغفر الله قال فخصمهم علي
