Musannaf Ibn Abi Shayba 18:1247

Abu Bakr narrated to us, he said: Ibn ‘Uyaynah narrated to us, from ‘Amr, from Mujahid, from Ibn ‘Abbas, who said: There was retaliation (qisas) among the Children of Israel, and blood money (diyah) was not among them. So Allah said to this nation: "Prescribed for you is legal retribution for those murdered - the free for the free, the slave for the slave, and the female for the female. But whoever overlooks anything from his brother..." The overlooking is that the blood money is accepted in the covenant. "This is an alleviation from your Lord and a mercy." He said: So upon this one is to pursue with kindness, and upon that one is to pay to him with goodness. "This is an alleviation from your Lord and a mercy. But whoever transgresses after that will have a painful punishment."
