Musannaf Ibn Abi Shayba 18:1277

Abu Bakr narrated to us, he said: Jarir narrated to us, from Mughira, from Ibrahim, regarding the saying of the Exalted: "And whoever kills a believer by mistake, then the freeing of a believing slave and a compensation payment delivered to his family." If a Muslim is killed, this [compensation] is for him and his Muslim heirs. "And if he was from a people who are enemies to you while he is a believer." This refers to a man who is killed while his people are polytheists, between whom and the Messenger of Allah (peace be upon him) there is no treaty. Upon him is the freeing of a believing slave. And if a Muslim is killed from a people who are polytheists, between whom and the Messenger of Allah (peace be upon him) there is a treaty, then his inheritance belongs to the Muslims, and his blood money (diya) belongs to the polytheists between whom and the Messenger of Allah (peace be upon him) there is a treaty. So the Muslims inherit his inheritance, and his blood money belongs to his people, because they are the ones who pay the blood money on his behalf.
