Hadith 18:692
Abu Bakr narrated to us, he said: Muhammad ibn Bakr narrated to us, from Ibn Jurayj, he said: Hisham informed me, from his father, he said: Every intentional act in which there is no retaliation (qisas), its blood money (diya) is upon the wealth of the perpetrator. If he has no wealth, then it is upon the perpetrator’s paternal relatives (aqilah). If he cut off his right hand intentionally, and the right hand of the cutter had been cut off before that, then its blood money is upon the wealth of the cutter. If he has no wealth, then it is upon his paternal relatives. If he had a left hand, retaliation is not taken from it, and the blood money is likewise in all limbs, it is the same.
حدثنا أبو بكر قال حدثنا محمد بن بكر عن بن جريج قال أخبرني هشام عن أبيه قال كل عمد ليس فيه قود فعقله في مال المصيب وإن لم يكن له مال فعلى عاقلة المصيب إن قطع يمينه عمدا وكانت يمين القاطع قد قطعت قبل ذلك فعقلها في مال القاطع وإن لم يكن له مال فعلى عاقلته وإن كانت له يد يسرى لم يقد منها والعقل كذلك في الأعضاء كلها كذلك
