Musannaf Ibn Abi Shayba 18:933

Abu Bakr narrated to us, he said: Ali bin Mushir narrated to us, from al-Shaybani, from al-Sha’bi, regarding a man who inflicted a wound upon another, then retaliation was taken from him, and he died: He said: "The wound of the first [person] shall be paid from the blood money (diyah) of the dead man." Abdullah bin Dhakwan said: "He has no right to anything from the blood money of the dead man."
