Abu Bakr narrated to us, he said: Waki’ narrated to us, he said: Mis’ar and Sufyan narrated to us, from Abu Husayn, from ‘Umayr ibn Sa’d al-Nakha’i, he said: ‘Ali said: "I would not establish a prescribed punishment (hadd) upon a man and he dies, such that I would find anything in my soul regarding it, except for the drinker of wine; if he were to die, I would pay his blood money (diya)." And Sufyan added: "And that is because the Messenger of Allah, may Allah bless him and grant him peace, did not establish it as a sunnah."
