Hadith 10:1006
Abu Bakr narrated to us, he said: Abda bin Sulayman narrated to us, from Sa’id, from Ja’far bin Abi Wahshiyya, from ‘Amr bin Haram, from Jabir bin Zayd, who said: Ibn Abbas and Ibn Umar discussed the woman of a missing person. They both said: She waits for four years, then her husband’s guardian divorces her, then she waits for four months and ten [days]. Then they discussed the jurisprudence. Ibn Umar said: She has maintenance from his wealth because she restrained herself for his sake. Ibn Abbas said: It is not like that, when it harms the heirs. Rather, she takes [it] against him from his wealth; if he arrives, then that is for her against him from his wealth, and if not, then she has nothing.
حدثنا أبو بكر قال نا عبدة بن سليمان عن سعيد عن جعفر بن أبي وحشية عن عمرو بن هرم عن جابر بن زيد قال تذاكر بن عباس وبن عمر امرأة المفقود فقالا جميعا تربص أربع سنين ثم يطلقها ولي زوجها ثم تربص أربعة اشهر وعشرا ثم تذاكرا الفقه فقال بن عمر لها النفقة في ماله لحبسها نفسها في سببه فقال بن عباس ليس كذلك إذا تحجف بالورثة ولكنها تأخذ عليه في ماله فإن قدم فذلك لها عليه في ماله وإلا فلا شيء لها
