Hadith 10:1069
Abu Bakr narrated to us, he said: Isma'il ibn 'Ulayyah narrated to us, from Salih ibn Muslim, he said: I said to al-Sha'bi: A man divorced his wife, then another came and married her. He said: Umar said: They are to be separated, and she shall complete the waiting period (iddah) of the first, and she shall commence a new waiting period from this one, and the dowry (sadaq) shall be placed in the public treasury (bayt al-mal), and the second shall never marry her, and the first becomes a suitor. And Ali said: They are to be separated, and she shall complete the waiting period of the first, and she shall observe a new waiting period from this one, and the dowry shall be given to her for what he made lawful of her private parts, and they both become suitors.
حدثنا أبو بكر قال نا إسماعيل بن علية عن صالح بن مسلم قال قلت للشعبي رجل طلق إمرأته فجاء آخر فتزوجها قال قال عمر يفرق بينهما وتكمل عدتها الأولى وتستأنف من هذا عدة جديدة ويجعل الصداق في بيت المال ولا يتزوجها الثاني أبدا ويصير الأول خاطبا وقال علي يفرق بينهما وبين زوجها وتكمل عدتها الأولى وتعتد من هذا عدة جديدة ويجعل لها الصداق بما استحل من فرجها ويصيران كلاهما خاطبين
