Hadith 10:1156
Abu Bakr narrated to us, he said: Abd al-A’la narrated to us, he said: Sa’id was asked about a man who married a woman during her waiting period (iddah), then he learned that he had married her during her waiting period, and her waiting period had expired while she was with him. Does her first husband have the right to take her back? He narrated to us from Ali ibn al-Hakam, from Muhammad ibn Yazid, from Sa’id ibn Jubayr, that he said: They are to be separated, and there is no right of return for him over her, because her waiting period had expired while she was with this one.
حدثنا أبو بكر قال نا عبد الأعلى قال سئل سعيد عن رجل تزوج امرأة في عدتها ثم علم أنه تزوجها في عدتها وقد انقضت عدتها عنده هل لزوجها الأول عليها رجعة فحدثنا عن علي بن الحكم عن محمد بن يزيد عن سعيد بن جبير أنه قال يفرق بينهما ولا رجعة عليها لأن عدتها قد انقضت عند هذا
