Hadith 10:1269
Abu Bakr narrated to us, he said: Isma'il ibn 'Ulayyah narrated to us, from Yunus, from Ibn Sirin, who said: He used to hold the view that every pregnant woman has [the right to] maintenance. He said: Ya'la ibn Khalid died leaving behind a *umm walad* (a concubine who bore him a child), and he [Ibn Sirin] held the view that she had [the right to] maintenance. However, he disliked providing maintenance without the judge [authorizing it]. So he sent to 'Abd al-Malik ibn Ya'la, but he [the judge] forbade it. And he said: Al-Hasan used to say: "Maintenance is provided for her. If she gives birth to it alive, then her maintenance is from the share of her child. And if she gives birth to it dead, he cancels that."
حدثنا أبو بكر قال نا إسماعيل بن علية عن يونس عن بن سيرين قال كان يرى لكل حامل نفقة قال توفي عن أم ولد يعلى بن خالد فكان يرى لها النفقة فكره أن ينفق دون القاضي فأرسل إلى عبد الملك بن يعلى فمنعها وقال كان الحسن يقول ينفق عليها فإن ولدته حيا فنفقتها من نصيب ولدها وإن ولدته ميتا ألغى ذلك
