Hadith 10:1373
Abu Bakr narrated to us, he said: Waki’ narrated to us, from Shu’bah, who said: I asked al-Hakam and Hammad, and they both said: "It is permissible," meaning the divorce of the polytheist.
حدثنا أبو بكر قال نا وكيع عن شعبة قال سألت الحكم وحمادا فقالا جائز يعني طلاق الشرك
