Hadith 10:1401
Abu Bakr narrated to us, he said: Waki’ ibn al-Jarrah narrated to us, from Musa ibn Ubaydah, from Muhammad ibn Ka’b, that a woman from the people of the desert was with a man from her cousins, and he died leaving her behind. Then a man from the Ansar married her. The cousins of the young woman came and said, "We will take our daughter." She said, "I adjure you by Allah not to separate me from my daughter, for I am the one who carried her and I am the one who nursed her, and there is no one closer to my daughter than me." They said, "Your appointment is with the Messenger of Allah (may Allah bless him and grant him peace)." Then he said, "The Messenger of Allah (may Allah bless him and grant him peace) will give you a choice, so say: 'I choose Allah, the faith, and the home of the Muhajirun and the Ansar.'" The Prophet (may Allah bless him and grant him peace) said, "By the One in Whose hand is my soul, you shall not take her away as long as my neck remains in its place." They came to Abu Bakr, and he judged in their favor regarding her. Bilal said, "O Caliph of the Messenger of Allah, I witnessed these people and this woman before the Messenger of Allah (may Allah bless him and grant him peace) disputing, and he judged her for her mother." Abu Bakr said, "And I, by the One in Whose hand is my soul, they shall not take her away as long as my neck remains in its place." So he handed her over to her mother.
حدثنا أبو بكر قال نا وكيع بن الجراح عن موسى بن عبيدة عن محمد بن كعب أن امرأة من أهل البادية كانت عند رجل من بني عمها فمات عنها فتزوجها رجل من الأنصار فجاء بنو عم الجارية فقالوا نأخذ ابنتنا قالت إني أنشدكم الله أن تفرقوا بيني وبين ابنتي فانا الحامل وأنا المرضع وليس أحد أقرب [ من ] ابنتي مني فقال موعدكم رسول الله صلى الله عليه وسلم ثم قال خيرك رسول الله صلى الله عليه وسلم فقولي أختار الله والإيمان ودار المهاجرين والأنصار فقال النبي صلى الله عليه وسلم والذي نفسي بيده لا تذهبون بها ما بقيت عنقي في مكانها وجاءوا إلى أبي بكر فقضى لهم بها فقال بلال يا خليفة رسول الله شهدت هؤلاء النفر وهذه المرأة عند رسول الله صلى الله عليه وسلم اختصموا فقضى بها لأمها فقال أبو بكر وأنا والذي نفسي بيده لا يذهبون بها ما دامت عنقي في مكانها فدفعها إلى أمها
