Hadith 10:1475
19199. Abu Bakr narrated to us, he said: Hushaym narrated to us, from Abu Ishaq al-Kufi, from al-Sha’bi, regarding a man who said to his creditor: "If I do not pay you your due before the setting of the sun, then my wife is divorced." He said: So he met him the next day, and he claimed that he had not given him anything. He said: So his wife said to him, "You have divorced me." He said: So he disputed with him before al-Sha’bi. Al-Sha’bi said: "As for your wife, we believe you regarding her. And as for the man, [you must provide] your evidence that you paid him his wealth; otherwise, give him his due."
حدثنا أبو بكر قال نا هشيم عن أبي إسحاق الكوفي عن الشعبي في رجل قال لغريمه إن لم أقضك حقك قبل غروب الشمس فامرأته طالق قال فلقيه من الغد فزعم أنه لم يعطه شيئا قال فقالت له امرأته قد طلقتني قال فخاصمته إلى الشعبي فقال الشعبي أمأ امرأتك فندينك فيها وأما الرجل فبينتك أنك دفعت إليه ماله وإلا فأعطه حقه
