Hadith 10:1544
Abu Bakr narrated to us, he said: Waki’ narrated to us, he said: Abdullah bin Habib bin Abi Thabit narrated to us, he said: I asked al-Hakam and Mujahid about a man who had a wife with whom he had consummated the marriage, and he married another woman over her. The first wife said to him: "Appoint a payment for yourself on the condition that you divorce me one divorce, and you divorce this wife of yours one divorce." He did so. Al-Hakam said: "Both of them have become irrevocably separated (ba'in)." Mujahid said: "The one with whom he had not consummated the marriage has become irrevocably separated, and one divorce has fallen upon the other." And Waki’ said: "And the one who is irrevocably separated is according to the statement of al-Hakam."
حدثنا أبو بكر قال نا وكيع قال نا عبد الله بن حبيب بن أبي ثابت قال سألت الحكم ومجاهدا عن رجل كانت عنده امرأة قد دخل بها فتزوج عليها امرأة فقالت امرأته الأولى اجعل لك جعلا على ان تطلقني تطليقة وتطلق امرأتك هذه تطليقة ففعل الحكم بانتا جميعا قال مجاهد بانت التي لم يدخل بها ووقع على الأخرى تطليقة وقال وكيع والبائن على قول الحكم
