Hadith 10:249
Abu Bakr narrated to us, he said: Waki’ narrated to us, from Ibn Abi Dhi’b, from al-Zuhri, from Aban ibn ‘Uthman, from ‘Uthman, who said: "He used to not permit the divorce of the intoxicated person or the insane person." He said: "And ‘Umar ibn ‘Abd al-‘Aziz used to permit his divorce and cause his back to ache (i.e., punish him), until Aban narrated that to him."
حدثنا أبو بكر قال نا وكيع عن بن أبي ذئب عن الزهري عن ابان بن عثمان عن عثمان قال كان لا يجيز طلاق السكران والمجنون قال وكان عمر بن عبد العزيز يجيز طلاقه ويوجع ظهره حتى حدثه أبان بذلك
