Hadith 10:254

Abu Bakr narrated to us, he said: Abu Mu’awiyah narrated to us, from ‘Asim, from al-Sumayt ibn ‘Umayr al-Sadusi, who said: I proposed to a woman, and they said: "We will not marry you [to her] until you divorce your wife three times." I said: "I have divorced her three times." He said: So they married me [to her]. Then they looked and saw my wife with me. They said: "Have you not divorced your wife?" I said: "Rather, there was so-and-so, daughter of so-and-so, under me, and I divorced her; as for this one, I did not divorce her." So I went to Shaqiq ibn Mujza’ah ibn Thawr, and he was intending to go out to ‘Uthman, and I said: "Ask the Commander of the Faithful about this." So he asked him, and he said: "His intention [matters]."

حدثنا أبو بكر قال نا أبو معاوية عن عاصم عن السميط بن عمير السدوسي قال خطبت امراة فقالوا لا نزوجك حتى تطلق امرأتك ثلاثا فقلت قد طلقتها ثلاثة قال فزوجوني ثم نظروا فإذا امرأتي عندي فقالوا أليس قد طلقت امرأتك قلت بل كانت تحتي فلانة بنت فلان فطلقتها وأما هذه فلم اطلقها فأتيت شقيق بن مجزأة بن ثور وهو يريد الخروج إلى عثمان فقلت سل أمير المؤمنين عن هذه فسأله فقال نيته
