Hadith 10:373

Abu Bakr narrated to us, he said: Waki’ narrated to us, from Jarir ibn Hazim, and from ‘Isa ibn ‘Asim, from Zadhan, who said: We were sitting with ‘Ali, and he was asked about the *khiyar* (the option of a wife to choose between her husband or herself). He said: The Commander of the Faithful, ‘Umar, asked me about it, and I said: "If she chooses herself, it is one *ba’inah* (irrevocable) divorce, and if she chooses her husband, it is one [revocable] divorce, and he has more right to her." He said: "It is not as you said. If she chooses herself, it is one [revocable] divorce, and if she chooses her husband, it is nothing, and he has more right to her." I found no alternative but to follow the Commander of the Faithful. But when I took charge and was given authority over matters of private parts (marriage and divorce), I returned to what I had known [originally]. It was said to him: "Your opinion when you are in agreement is more beloved to us than your opinion when you are in disagreement." ‘Ali laughed and said: "As for that, he sent for Zayd ibn Thabit and asked him, and he said: 'If she chooses herself, it is three [divorces], and if she chooses her husband, it is one *ba’inah* (irrevocable) divorce.'"

حدثنا أبو بكر قال نا وكيع عن جرير بن حازم وعن عيسى بن عاصم عن زاذان قال كنا جلوسا عند علي فسئل عن الخيار فقال سألني عنها أمير المؤمنين عمر فقلت إن اختارت نفسها فواحدة بائنة وإن اختارت زوجها فواحدة وهو أحق بها فقال ليس كما قلت إن اختارت نفسها فواحدة وإن اختارت زوجها فلا شيء وهو أحق بها فلم أجد بدا من متابعة أمير المؤمنين فلما وليت وأتيت في الفروج رجعت إلى ما كنت أعرف فقيل له رأيكما في الجماعة أحب إلينا من رأيك في الفرقة فضحك علي فقال أما إنه أرسل إلى زيد بن ثابت فسأله فقال إن اختارت نفسها فثلاث وإن اختارت زوجها فواحدة بائنة
