كتاب الطلاق

Hadith 10:439

Abu Bakr narrated to us, he said: Yazid ibn Harun narrated to us, from Habib, from Amr, who said: Jabir ibn Zayd was asked about a man whose wife persisted in asking him for a divorce, so he said: "Go away, for I am free of you and you are free of me," and he did not intend divorce at that time. He said: If he did not intend divorce, then it is not a divorce. And if he intended divorce, then it is one [divorce], and he has the right to take her back during her waiting period.

حدثنا أبو بكر قال نا يزيد بن هارون عن حبيب عن عمرو قال سئل جابر بن زيد عن رجل لزمته امرأته تسأله الطلاق فقال اذهبي فأنا منك بريء وأنت مني بريئة ولا ينوي الطلاق حينئذ قال إن لم يكن نوى الطلاق فليس الطلاق وإن كان نوى الطلاق فهي واحدة وله أن يراجعها في عدتها
