Hadith 10:524
Abu Bakr narrated to us, he said: Isma’il ibn ‘Ulayyah narrated to us, from Ayyub, from Sulayman ibn Yasar: That Nufay’, a *mukātab* (slave with a contract of manumission) of Umm Salamah, divorced his wife—and she was a free woman—two pronouncements. They were eager to return her to him, but ‘Uthman and Zayd refused. Sulayman said: And someone else says other than this. When I arrived in Medina, I wrote to Abu Qilabah, and he wrote back to me that someone whose hadith he trusts narrated to him that Zayd ibn Thabit and Qabisah ibn Dhu’ayb said: If her husband is a free man and she is a slave, then his divorce is the divorce of a free man, and her waiting period (*‘iddah*) is the waiting period of a slave. And if her husband is a slave and she is a free woman, then his divorce is the divorce of a slave, and her waiting period is the waiting period of a free woman who is observing a waiting period.
حدثنا أبو بكر قال نا إسماعيل بن علية عن ايوب عن سليمان بن يسار أن نفيعا مكاتبا لأم سلمة طلق امرأته وهي حرة تطليقتين فحرصوا على أن يردوها عليه وأبي عثمان وزيد قال سليمان ويقول أحد غير هذا فلما قدمت المدينة كتبت إلى أبي قلابة فكتب إلي أنه حدثني من أطمأن إلى حديثه أن زيد بن ثابت وقبيصة بن ذؤيب قالا إذا كان زوجها حرا وهي أمة فطلاقه طلاق حر وعدتها عدة أمة وإن كان زوجها عبدا وهي حرة فطلاقه طلاق عبد وعدتها عدة حرة معتدة
