Hadith 10:557
Abu Bakr narrated to us, he said: Mu'tamir narrated to us, from Layth, from 'Ata', Tawus, and Mujahid, they said: If the slave woman belongs to someone else, or she is with him and he (the master) has given him permission to marry her, then the divorce is in the hand of the slave.
حدثنا أبو بكر قال نا معتمر عن ليث عن عطاء وطاوس ومجاهد قالوا إذا كانت المملوكة لغيره أو كانت عنده وقد أذن له أن يتزوجها فالطلاق بيد المملوك
