Hadith 10:571
Abu Bakr narrated to us, he said: Waki’ narrated to us, from Isma’il ibn Abi Khalid, from al-Sha’bi, who said: If a slave marries without the permission of his master, then the divorce is in the hand of the master. And if he marries with his permission, then the divorce is in the hand of the slave.
حدثنا أبو بكر قال نا وكيع عن إسماعيل بن أبي خالد عن الشعبي قال إذا تزوج العبد بغير إذن سيده فالطلاق بيد السيد وإذا تزوج بإذنه فالطلاق بيد العبد
