Hadith 10:926
Abu Bakr narrated to us, he said: Abu ‘Asim narrated to us, from Ibn Jurayj, from ‘Ata’, who said: If he swears an oath (ila’) regarding her before he has consummated the marriage with her, then it is not an oath (ila’). I said: Even if he is capable of having intercourse with her? He said: Even if he is capable of having intercourse with her.
حدثنا أبو بكر قال نا أبو عاصم عن بن جريج عن عطاء قال إذا آلى منها قبل أن يدخل بها فليس بإيلاء قلت وإن كان على جماعها قادرا قال وإن كان على جماعها قادرا
