Hadith 8:371
Abu Bakr narrated to us, he said: Hafs narrated to us, from Ash'ath and 'Abd al-Malik, from 'Ata', who said: Whoever performs 'Umrah during the months of Hajj, then returns to his country, then performs Hajj in the same year, he is not a Mutamatti' (one performing Tamattu'). The Mutamatti' is only the one who stays and does not return.
حدثنا أبو بكر قال ثنا حفص عن أشعث وعبد الملك عن عطاء قال من اعتمر في أشهر الحج ثم رجع إلى بلده ثم حج من عامه فليس بمتمتع إنما المتمتع من أقام ولم يرجع
