Hadith 29:109
'Affan narrated to us, he said: Hammad bin Salamah narrated to us, he said: 'Ata' bin al-Sa'ib narrated to me, from Abu Zur'ah bin 'Amr and from Jarir, that a man who had a loud voice and was effective against the enemy was with Abu Musa. They seized spoils of war, and Abu Musa gave him his share but did not give him the full amount. He refused to take it unless it was the full amount, so he [Abu Musa] struck him twenty lashes and shaved his head. He gathered his hair, went to 'Umar, and entered upon him. Jarir said: "And I was the closest of people to him." He took his hair out of his garment and struck 'Umar's chest with it, saying: "Were it not for him!" 'Umar said: "He spoke the truth; were it not for the Fire [Hell]." He [the man] said: "What is the matter with you?" He said: "I was a man with a loud voice and effective against the enemy, and we seized spoils of war," and he informed him of the matter and said: "He shaved my head and lashed me twenty times, thinking that retaliation would not be taken against him." 'Umar said: "That all people were upon the likes of the firmness of this one is more beloved to me than everything that has come to me." Then 'Umar wrote to Abu Musa: "Peace be upon you. To proceed: So-and-so, son of so-and-so, has informed me of such-and-such. I swear by you, if you did to him what you did in the presence of people, then sit in the presence of them so he may take retaliation from you. And if you did to him what you did in private, then sit for him in private so he may take retaliation from you." The people said to him [the man]: "Pardon him." He said: "No, by Allah, I will not leave it for anyone among the people." When the letter was raised to him [Abu Musa], he sat for retaliation. He [the man] raised his head to the sky and said: "I have pardoned him." Hammad also said: "And Abu Musa gave him some of his share." And Jarir also said: "And I was the closest of the people." He said: "And he also said: 'I have pardoned him for the sake of Allah.'"
حدثنا عفان قال حدثنا حماد بن سلمة قال حدثني عطاء بن السائب عن أبي زرعة بن عمرو وعن جرير أن رجلا كان ذا صوت ونكاية على العدو مع أبي موسى فغنموا مغنما فأعطاه أبو موسى نصيبه ولم يوفه فأبى أن يأخذه إلا جمعا فضربه عشرين سوطا وحلقه فجمع شعره فذهب إلى عمر فدخل عليه فقال جرير وأنا أقرب الناس منه فأخرج شعره من ضيه فضرب بها صدر عمر فقال أما والله لولاه فقال عمر صدق لولا النار فقال مالك فقال كنت رجلا ذا صوت ونكاية على العدو فغنمنا مغنما وأخبره بالأمر وقال حلق رأسي وجلدني عشرين سوطا يرى أنه لا يقتص منه فقال عمر لأن يكون الناس كلهم على مثل صرامة هذا أحب من جميع ما أتى علي قال فكتب عمر إلى أبي موسى سلام عليكم أما بعد فإن فلان بن فلان أخبرني بكذا وكذا وإني أقسم عليك إن كنت فعلت به ما فعلت في ملأ من الناس لما جلست في ملأ منهم فاقتص منك وإن كنت فعلت به ما فعلت في خلاء فاقعد له في خلاء فيقتص منك فقال له الناس اعف عنه فقال لا والله لا أدعه لأحد من الناس فلما رفع إليه الكتاب قعد للقصاص فرفع رأسه إلى السماء وقال قد عفوت عنه وقال حماد أيضا فأعطاه أبو موسى بعض سهمه وقد قال أيضا جرير وأنا أقرب القوم قال وقال أيضا قد عفوت عنه لله
