Hadith 29:110

Affan narrated to us, he said: Abu 'Awanah narrated to us, he said: Al-Mughirah narrated to us, from Simak bin Salamah: That when the Muslims conquered Tustar, they placed the provisions of the Muslims there and advanced to fight their enemy. He said: The Dehqan (governor/chieftain) of Tustar acted treacherously toward them, so he heated an oven for them and offered them the meat of swine and donkeys, or the oven. He said: So some of them ate and some refrained. He said: It was offered to Nuhaib bin al-Harith al-Dabbi, but he refused, so he was placed in the oven. He said: Then the Muslims returned and besieged the people of the city until they made peace with the Dehqan. A nephew of Nuhaib said to his uncle, "O my uncle, this is the killer of Nuhaib." He said, "O my nephew, he has a covenant (dhimmah)." Simak said: It reached me that this reached Umar, and he said, "May Allah have mercy on him; what would it have mattered to him if he had eaten?"

حدثنا عفان قال ثنا أبو عوانة قال حدثنا المغيرة عن سماك بن سلمة أن المسلمين لما فتحوا تستر وضعوا بها وضائع المسلمين وتقدموا لقتال عدوهم قال فغدر بهم دهقان تستر فأحمى لهم تنورا وعرض عليهم لحم الخنزير والحمير أو التنور قال فمنهم من أكل فترك قال فعرض على نهيب بن الحارث الضبي فأبى فوضع في التنور قال ثم إن المسلمين رجعوا فحاصروا أهل المدينة حتى صالحوا الدهقان فقال بن أخ لنهيب لعمه يا عماه هذا قاتل نهيب قال يا بن أخي إن له ذمة قال سماك بلغني أن عمر بلغه ذلك فقال يرحمه الله وما عليه لو كان أكل
