Hadith 29:95
Shadhan narrated to us, he said: Hammad bin Salamah narrated to us, from Ata’ bin al-Sa’ib, from Abu al-Ala’, who said: I was among those who conquered Tikrit, and we made a peace treaty with them on the condition that they set up a market for us, and we granted them security. He said: So they set up a market for us. He said: Then a priest (qiss) of theirs was killed. Their priest came and said: "Did you grant us the covenant of your Prophet, may Allah bless him and grant him peace, and the covenant of the Commander of the Faithful, and your own covenant, and then you violated it?" Our commander said: "If you produce two just witnesses against his killer, we will execute him in retaliation for you. If you wish, you may take an oath and we will pay you the blood money (diya). And if you wish, we will take an oath to you and pay you nothing." He said: So they set a time for the next day. They arrived, and their priest came, praised Allah and extolled Him, then mentioned the heavens and the earth and whatever Allah willed him to mention, until he mentioned the Day of Resurrection. Then he said: "The first thing that will be adjudicated among the disputes is bloodshed." He said: "The sons of Adam will dispute, and judgment will be passed for one against the other. Then the first and then the next will be taken, until the matter reaches our companion and your companion." He said: "It will be said to him: 'Why did you kill me?'" He said: "Would you not like for your companion to have an argument against our companion, that he might say: 'Your family took your blood money after you'?"
حدثنا شاذان قال حدثنا حماد بن سلمة عن عطاء بن السائب عن أبي العلاء قال كنت فيمن افتتح تكريت فصالحناهم على أن يبرزوا لنا سوقا وجعلنا لهم الأمان قال فابرزوا لنا سوقا قال فقتل قس منهم فجاء قسهم قال أجعلتم لنا ذمة نبيكم صلى الله عليه وسلم وذمة أمير المؤمنين وذمتكم ثم أخفرتموها فقال أميرنا إن أقمتم شاهدين ذوي عدل على قاتله أقدناكم وإن شئتم حلفتم وأعطيناكم الدية وإن شئتم حلفنا لكم ولم نعطكم شيئا قال فتواعدوا للغد فحضروا فجاء قسهم فحمد الله وأثنى عليه ثم ذكر السماوات والأرض وما شاء الله أن يذكر حتى ذكر يوم القيامة ثم قال أول ما يبدأ به من الخصومات الدماء قال فيختصم أبناء آدم فيقضى له على صاحبه ثم يؤخذ الأول فالأول حتى ينتهي الأمر إلى صاحبنا وصاحبكم قال فيقال له فيم قتلتني قال أفلا تحب أن يكون لصاحبكم على صاحبنا حجة أن يقول قد أخذ أهلك من بعدك ديتك
